Here are Some Recent Criminal Case Results:

No Jail in Marijuana Sales Case:  Client charged with selling marijuana to undercover police officers on several different occasions.  Because of the number of sales, client was facing a mandatory prison term if he was convicted at trial.  A plea was negotiated where client received probation, no jail and will have the charges reduced to a misdemeanor once his probation is successfully completed. (State v. I.R.)

Not Guilty Aggravated Assault: Client was charged with Aggravated Assault with a handgun following a road rage incident.  Client was facing a mandatory prison term between five and fifteen years if convicted at trial.  Case was tried to a jury and client was found not guilty. (State v. P.C.)

Armed Robbery Not Guilty: Client was charged with Armed Robbery after allegedly robbing a drug dealer. Client was facing a mandatory term of seven to twenty one years if convicted at trial.  Case was tried to a jury where the credibility of alleged victim became an issue.  Client was acquitted of all charges. (State v. R.I.)

Methamphetamine Sales Charges Dismissed: Client was charged with possession of methamphetamine for sale after police stopped client and her boyfriend. Police searched the client and her vehicle and recovered a substantial quantity of methamphetamine.  A motion was filed arguing that the police violated the client's rights when they searched her. The motion was granted by the court, all evidence was suppressed and the case was dismissed. (State v. J.H.)

Not Guilty Motor Vehicle Theft: Client was charged with motor vehicle theft after a witness allegedly observed the client abandon a stolen car on the street.  Client was facing mandatory prison if convicted at trial because of prior felony convictions.  Client was acquitted of all charges at trial. (State v. P.D.)

Not Guilty Armed Robbery and Kidnapping: Client was charged with armed robbery and kidnapping after an incident in a Phoenix strip mall parking lot. Client was facing life in prison because of his prior felony convictions.  Case was tried to a jury, client was found not guilty and was immediately released from jail. (State v. A.C.)

Marijuana Sales Charges Dismissed: Client was charged with transportation of marijuana for sale after police stopped him for a traffic violation, searched his car and found approximately two hundred pounds of marijuana. All evidence was suppressed after a motion was filed which challenged the conduct of the police in searching the client's car.  Case was ultimately dismissed. (State v. S.B.)

Child Molestation Charges Dismissed: Client was charged with child molestation and allegedly engaging in improper conduct with his step-daughter. Client was going thru a divorce when the allegations were made to police.  Charges were completely dismissed when evidence was provided by us to the prosecutor which showed the client's ex-wife made the allegations up as a means to extort the client during divorce proceedings. (State v. R.D.)

Domestic Violence Charges Dismissed: Client was charged with disorderly conduct and assault following a physical altercation with his adult stepson.  Client was facing probation and a jail term because he was on probation for another offense.  The charges were dismissed completely by the prosecutor. (State v. B.S.)

Aggravated Assault on Police Dismissed: Client charged with aggravated assault on police, resisting arrest and possession of drug paraphernalia after being stopped and contacted by police.  Client was facing a mandatory prison term if convicted at trial.  All charges were completely dismissed when our investigation revealed officers were being untruthful regarding the incident. Domestic Violence Charges DismissedClient charged with Assault and Criminal Damage following an altercation with his wife.  Client was facing probation, mandatory classes and potential jail time as well as the loss of his job.  After argument to the Court, the charges were completely dismissed.

Assault Charges Dismissed: Client was charged with Domestic Violence Assault after a verbal argument with his girlfriend. Client's girlfriend contacted police and alleged that Client had pushed and punched her. Armed Robbery/Weapons Charges Dismissed: Client was charged with Armed Robbery, Kidnaping, Weapons Violations and Aggravated Assault following allegations he took money and property from two separate victims in two separate incidents.  Client was facing over seventy years if convicted at trial. Charges were completely dismissed after a complete investigation was undertaken and issues pertaining to each victims' credibility and identification of the client was discovered. (State v. R.W)

Methamphetamine Sales Charges Dismissed: Client was charged with selling methamphetamine to a confidential police informant on two separate occasions.  Client was facing a presumptive term of over fifteen years in prison due to the allegations and his prior criminal history.  Case was completely dismissed by the prosecutor after defense investigation revealed credibility issues with the informant and lack of preservation of evidence by police. (State v. T.R.)

Domestic Violence Charges Dismissed: Client was arrested and charged with assault and disorderly conduct following an altercation with his live in girlfriend.  Client faced up to six months jail, probation and loss of his firearms  rights upon conviction.  Case was completely dismissed at trial. Aggravated Assault Charges Dismissed: Client was charged with Aggravated Assault, a class 3 Dangerous Felony and was facing a mandatory prison term between five and fifteen years. Client was charged after coming to the defense of a woman who ws being severely assaulted by her boyfriend.  Client stabbed the alleged victim after the "victim" ignored warnings to stop beating his girlfriend.  Charges were ultimately dismissed following lengthy negotiations with the prosecution and convincing the prosecutor that the Client had a legal defense related to the protection of a third party.

Domestic Violence Charges Dismissed: Client was charged with domestic violence, disorderly conduct following an altercation with her ex-boyfriend.  Client risked the loss of her employment along with other mandatory penalties upon conviction.  Charges were completely dismissed at trial. Domestic Violence Charges Dismissed:  Client was charged with Disorderly Conduct arising from an incident involving his ex-girlfriend. Assault Charges Dismissed:  Client was arrested and charged with assault after being accosted by an ex-boyfriend.  Investigation revealed that the Client's ex-boyfriend showed up at her place of employment and acted in a threatening manner toward her. Charges were dismissed upon a showing that Client acted in self-defense. (State v. R.D.)

Assault and Disorderly Conduct Charges Dismissed:  Client was arrested in downtown Scottsdale after coming to the aid of friend who was attacked by a group of males.  Client physically defended his friend but was charged with Disorderly Conduct and Assault. Client feared that any conviction would ruin his chances of becoming a firefighter. Charges were completely dismissed at trial. (State v. R.S.)

Aggravated Assault Charges Dismissed: Client was charged with Aggravated Assault, a class 4 felony following an altercation with his girlfriend during which he allegedly pushed her to the ground and broke her ribs.  Client was facing a term of 6 to 15 years prison due to his criminal history.  After arguing two motions to suppress evidence, the Court precluded the prosecution from using much of the testimony it intended to use against the client. Consequently, the charges were completely dismissed. (State v. X.J.)

Theft Charges Dismissed:  Client charged with a class 6 felony for allegedly stealing an iPhone from the victim's shirt pocket.  Client adamantly maintained his innocence and elected to proceed to trial.  Charges were completely dismissed for lack of evidence at trial. (State v. A.H.)

Domestic Violence Charges Dismissed: Client was charged with Disorderly Conduct and Assault following an altercation with her husband. Client sustained injuries during the incident and after speaking with the prosecutor, we were able to illustrate that the Client was actually the victim in the case and should not be prosecuted.  Case was completely dismissed. Criminal Damage & Disorderly Conduct Charges Dismissed: Client was charged with Criminal Damage and Disorderly Conduct after becoming involved in a physical altercation outside a Tempe nightclub during which he allegedly broke the victim's iPhone.  Client is college student and was concerned about the effects a conviction would have upon future employment prospects.  Charges were completely dismissed. False Reporting Charges Dismissed:  Client was charged with False Reporting to Police after an investigation where he reported that his vehicle was stolen.  Client had no previous criminal history and there were extenuating circumstances regarding the police report. Theft Charges Dismissed: Client was charged with Theft after being arrested for allegedly stealing alcohol from a bar in Tempe.  The prosecutor offered a plea agreement which would have required the client to serve time in jail.  After investigating the matter, the charges against the client were completely dismissed. Domestic Violence Charges Dismissed: Client was arrested for aggravated assault after allegedly pointing a knife and injuring her husband during an altercation in their residence.  Aggravated Assault charges were reduced to a misdemeanor disorderly conduct allegation after a self defense claim and disorderly conduct charges were ultimately dismissed at trial.
